Terms and Conditions for H2Viral
Section 1 — Acceptance of Terms & Binding Agreement
This Agreement (“Terms,” “Agreement”) governs the relationship between you (“Customer,” “you,” “your”) and Combs Studios LLC, a Tennessee limited liability company (“Company,” “we,” “our,” “us”), regarding your access to, purchase of, or use of any digital products, upgrades, bonuses, or services offered under the H2Viral brand.
For purposes of this Agreement, “Licensed Materials” refers to all script libraries, content packs, expansion packs, upgrades, premium bundles, bonuses, training guides, reference tools, and any related digital files—whether currently available or released in the future.
By accessing or downloading the Licensed Materials through any authorized platform, payment processor, or direct distribution channel, you acknowledge that you have read, understood, and agree to be bound by these Terms as well as any applicable payment-provider policies covering billing or refunds.
The Licensed Materials are provided strictly for educational, informational, and entertainment purposes only. Nothing contained within them should be interpreted as business, financial, marketing, or legal advice. No specific income, performance, or results are guaranteed or implied. Individual outcomes depend on numerous factors outside the Company’s control, including your effort, skill, and market conditions.
By accessing or using the Licensed Materials, you confirm that:
You are of legal age and possess the authority to enter into this Agreement;
You are solely responsible for complying with all local laws, platform policies, and advertising regulations applicable to your use; and
Your continued use of the Licensed Materials constitutes ongoing acceptance of these Terms, including any future revisions.
Certain portions of the Licensed Materials may include affiliate recommendations or promotional links. The Company may earn commissions when you purchase products or services through such links—at no additional cost to you. All affiliate relationships are disclosed in accordance with the U.S. Federal Trade Commission (FTC) guidelines, as well as equivalent consumer-protection and advertising-disclosure regulations worldwide.
The Licensed Materials are offered on an “as-is” and “as-available” basis without warranties of any kind, express or implied. You agree that your use is entirely at your own risk. Combs Studios LLC disclaims all liability for any losses or damages arising from reliance upon, misuse of, or inability to use the Licensed Materials.
All intellectual-property rights in and to the Licensed Materials remain the sole and exclusive property of Combs Studios LLC. Nothing in this Agreement shall be interpreted as a transfer or sale of ownership rights.
Section 2 — License & Permitted Use
Upon successful purchase, registration, or authorized access, Combs Studios LLC grants you a limited, non-exclusive, non-transferable, and revocable license (“License”) to access and use the Licensed Materials solely for your own personal or internal business purposes.
This License does not constitute a sale or transfer of ownership, and no intellectual-property rights are conveyed other than those expressly stated in this Agreement.
Permitted Uses
You may:
Copy, edit, and adapt the Licensed Materials (including scripts, hooks, frameworks, and checklists) for use in creating your own original content, marketing materials, or other creative works;
Publish and distribute content derived from the Licensed Materials across platforms such as TikTok, Instagram Reels, YouTube Shorts, Facebook Reels, email campaigns, or your website, provided that such use complies with all applicable platform rules and community guidelines;
Integrate or reference the Licensed Materials within your own brand or creative pipeline for legitimate educational, informational, or entertainment purposes.
Prohibited Uses
You may not:
Resell, redistribute, sublicense, share, or otherwise transfer the Licensed Materials (in whole or in part) to any third party without prior written consent from Combs Studios LLC;
Misrepresent authorship or claim the Licensed Materials as original works created solely by you;
Use the Licensed Materials in any way that violates intellectual-property laws, consumer-protection statutes, or advertising-disclosure requirements under the FTC, GDPR, CASL, or equivalent global regulations;
Employ the Licensed Materials in connection with spam, deceptive advertising, misleading claims, or unlawful, defamatory, or fraudulent activities;
Reverse-engineer, decompile, or modify the Licensed Materials for redistribution or resale under another name or brand.
Third-Party References
The Licensed Materials may include references or examples involving third-party tools, apps, or platforms (e.g., Canva, CapCut, ElevenLabs, TikTok, YouTube). These references are provided solely as illustrative suggestions. Combs Studios LLC does not own, control, or guarantee the functionality, reliability, or results of any third-party products or services, and your use of them is entirely at your own discretion and risk.
License Termination
This License will automatically terminate if you breach any of these Terms. Upon termination, you must immediately cease using and destroy all copies of the Licensed Materials in your possession.
The Company reserves the right to pursue legal or equitable remedies—including injunctive relief and damages—for any unauthorized use, resale, or misappropriation of the Licensed Materials.
Ownership Notice
All rights, title, and interest in the Licensed Materials remain the sole property of Combs Studios LLC.
Except for the limited rights expressly granted herein, no license or ownership interest is transferred to you. All ungranted rights are reserved.
Section 3 — User Responsibilities & Compliance
By accessing, purchasing, or using any Licensed Materials provided by Combs Studios LLC under the H2Viral brand (including all upgrades, bonuses, and future products), you agree to assume full responsibility for your own implementation, actions, and outcomes. The Licensed Materials are designed as educational and creative tools intended to inspire and support your content strategy—not as a guarantee of business performance or financial success.
You acknowledge that your results depend entirely on how you choose to apply the information, strategies, or frameworks provided.
Compliance with Laws & Regulations
You agree that:
You are solely responsible for ensuring your use of the Licensed Materials complies with all applicable local, state, national, and international laws and regulations, including but not limited to consumer-protection, data-privacy, advertising-disclosure, and intellectual-property laws (such as FTC, GDPR, CCPA, CASL, and equivalent statutes).
You will clearly disclose any affiliate relationships, paid partnerships, or sponsorships in all published content, as required by the FTC or equivalent bodies in your jurisdiction.
You will not use the Licensed Materials for deceptive, misleading, defamatory, harassing, or unlawful purposes, or in any way that could expose Combs Studios LLC to liability.
Platform Guidelines & Third-Party Compliance
When using the Licensed Materials on platforms such as TikTok, YouTube, Instagram, Facebook, or others, you agree to:
Comply with all platform-specific Terms of Service, community standards, and advertising policies;
Accept full responsibility for any content removals, strikes, demonetization, or account suspensions that result from your own activity or from platform enforcement actions; and
Acknowledge that Combs Studios LLC has no control over and bears no liability for third-party moderation, algorithmic changes, or platform rule updates.
Proper Use & Ethical Conduct
You further agree to:
Use the Licensed Materials ethically and in good faith, without misrepresentation or plagiarism;
Avoid implying that Combs Studios LLC endorses, sponsors, or partners with your business unless you have written authorization;
Accurately represent your own products, services, and results when using the Licensed Materials for marketing or promotional content; and
Use your best judgment and professionalism when adapting scripts, hooks, or frameworks provided within the Licensed Materials.
Affiliate & Earnings Disclosure
Some Licensed Materials or communications may reference third-party tools, platforms, or offers.
Combs Studios LLC may earn affiliate commissions or promotional compensation when you purchase through these links, at no additional cost to you.
All such promotions are for transparency and convenience. You should always perform your own due diligence before making any financial or business decision.
Indemnification
You agree to indemnify, defend, and hold harmless Combs Studios LLC, its officers, contractors, affiliates, and agents from and against any and all claims, losses, damages, liabilities, costs, or expenses (including attorney’s fees) arising from:
Your use or misuse of the Licensed Materials;
Your violation of these Terms; or
Your infringement of any third-party rights or applicable laws.
By continuing to use or apply the Licensed Materials, you acknowledge and accept these responsibilities in full.
Failure to comply may result in immediate termination of your license, suspension of access, and potential legal action.
Section 4 — Intellectual Property & Ownership Rights
All content, creative materials, frameworks, and resources made available by Combs Studios LLC under the H2Viral brand — including but not limited to the H2Viral Machine, H2Viral Pro Expansion Pack, and H2Viral Platinum Upgrade (collectively, the “Licensed Materials”) — are and shall remain the sole intellectual property of Combs Studios LLC and its licensors.
This includes all scripts, voice-over frameworks, copywriting structures, hook formulas, checklists, digital downloads, visual assets, written guides, audio/visual components, and training materials, in any format now known or later developed.
Limited License Grant
Upon lawful purchase or authorized access, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Licensed Materials solely for your personal or internal business purposes (e.g., creating your own content or marketing assets).
This license does not constitute a sale or transfer of ownership. You are not acquiring title to any intellectual-property rights; rather, you are receiving permission to use the Licensed Materials within the scope expressly defined here.
Prohibited Uses
You may not:
Reproduce, redistribute, republish, resell, sublicense, rent, or share the Licensed Materials in whole or in part with any third party;
Represent or claim the Licensed Materials as your own original work;
Use any portion of the Licensed Materials in products or services that directly compete with or replicate H2Viral or Combs Studios LLC offerings;
Upload, post, or distribute the Licensed Materials to public or private databases, marketplaces, or AI-training models;
Use the Licensed Materials in any manner that infringes intellectual-property, trademark, or privacy rights, or violates advertising-disclosure or consumer-protection laws.
™ Trademarks & Brand Elements
All trademarks, logos, and service marks—including H2Viral, H2Viral Machine, H2Viral Pro Expansion Pack, H2Viral Platinum Upgrade, and any associated brand design elements—are proprietary to Combs Studios LLC.
You may not use these marks in a way that implies endorsement, affiliation, or partnership without prior written authorization.
Third-Party References
The Licensed Materials may reference external platforms or tools (e.g., Canva, CapCut, ElevenLabs, TikTok, YouTube).
All such trademarks and brand names remain the property of their respective owners. No sponsorship, endorsement, or affiliation with these third parties is expressed or implied.
Reservation of Rights
All rights not expressly granted are reserved by Combs Studios LLC.
Any unauthorized copying, distribution, modification, or commercial exploitation of the Licensed Materials constitutes infringement and may result in termination of your license, forfeiture of access, and pursuit of legal or equitable remedies.
Section 5 — Payment Terms & Billing
By purchasing, subscribing to, or otherwise gaining access to any digital product, upgrade, bonus, or related service offered under the H2Viral brand, you agree to the following payment terms and conditions. All transactions are administered by Combs Studios LLC, a Tennessee limited-liability company.
Pricing & Currency
All prices are listed in U.S. Dollars (USD) unless explicitly stated otherwise.
Prices are subject to change at any time without prior notice, except where a transaction has already been completed.
From time to time, limited-time offers, bonuses, or promotional discounts may apply; these are not retroactive or guaranteed to repeat.
Payment Processing & Authorization
Transactions are securely processed through trusted third-party payment gateways such as Stripe, PayPal, or Systeme.io.
By submitting payment information, you represent that you are legally authorized to use the chosen payment method and you authorize Combs Studios LLC (and its payment processors) to charge the full amount shown at checkout, including applicable taxes or fees.
You are responsible for maintaining accurate billing details to prevent delays or failed charges.
Subscriptions & Recurring Plans
If you enroll in a recurring plan or membership:
You authorize automatic recurring billing according to the frequency disclosed at checkout.
You may cancel future renewals at any time before the next billing date by following the cancellation instructions included in your receipt or by contacting hey@h2viralmachine.com.
Cancellations take effect at the end of the current billing period; partial-period refunds are not provided.
Refund Policy
Unless otherwise stated on the checkout page, all H2Viral digital products are covered by a 30-day satisfaction guarantee.
Refunds must be requested within 30 days of purchase by emailing hey@h2viralmachine.com with your order details.
After 30 days, all sales are final.
Refunds do not cover third-party expenses (such as editing software or paid ad costs) associated with use of the Licensed Materials.
Taxes & Compliance
You are solely responsible for any sales, use, or value-added taxes imposed by your jurisdiction.
Combs Studios LLC complies with all applicable U.S. tax and international e-commerce reporting requirements.
Chargebacks & Disputes
Initiating a chargeback or payment dispute without first contacting our support team constitutes a breach of these Terms.
Unauthorized chargebacks may result in immediate suspension or termination of your license and future access to H2Viral products.
We reserve the right to pursue recovery of disputed amounts and related processing fees.
Acknowledgment
By completing any purchase or subscription, you acknowledge that:
You have read and accepted these Payment Terms;
You understand that digital-product access is delivered immediately upon purchase and may not be revocable once downloaded or accessed;
You agree that Combs Studios LLC bears no liability for delays or interruptions caused by payment processors, third-party gateways, or force-majeure events.
Section 6 — User Responsibilities & Acceptable Use
By accessing or using any H2Viral products, upgrades, or digital assets (“Licensed Materials”) provided by Combs Studios LLC, you agree to use them responsibly, ethically, and in full compliance with all applicable laws, platform rules, and these Terms.
These standards exist to protect both you and the integrity of the H2Viral brand.
Authorized Use
You are granted a limited license to:
Use the Licensed Materials for your own creative or business purposes, including content creation, marketing, and education.
Adapt, edit, and apply the frameworks, scripts, and resources to produce original videos, campaigns, and materials for your business or clients.
Access your purchased materials across multiple devices and platforms, provided access is secured and not shared publicly.
Prohibited Conduct
You agree not to:
Copy, resell, redistribute, or share the Licensed Materials with any third party or community (including private groups or resale marketplaces).
Claim authorship, originality, or ownership of any Licensed Material in its unaltered form.
Use the Licensed Materials for deceptive, unlawful, or misleading purposes (including fake testimonials, false claims, or manipulative advertising).
Employ the Licensed Materials in connection with spam, scams, pyramid schemes, or AI-generated mass distribution that misrepresents authorship.
Post or upload Licensed Materials to any AI training model, data repository, or public platform for reproduction or resale.
Violations may result in immediate license termination and potential legal action.
Platform Compliance
When using the Licensed Materials on platforms such as TikTok, YouTube, Instagram, Facebook, or X, you are solely responsible for:
Adhering to each platform’s community guidelines, ad policies, and copyright rules.
Ensuring your content meets all local advertising and disclosure standards.
Understanding that Combs Studios LLC cannot control algorithmic outcomes, account decisions, or enforcement actions by these third-party platforms.
Integrity & Transparency
You agree to:
Accurately represent your experience, outcomes, and qualifications when publishing content derived from the Licensed Materials.
Disclose any affiliate relationships, sponsorships, or paid collaborations when promoting products or services, in line with FTC and international standards.
Respect the creative work of others and use Licensed Materials only as intended — for education, inspiration, and original content creation.
Responsibility for Results
The Licensed Materials are educational and informational in nature.
Results may vary. Success depends on factors outside our control, including your skill, effort, strategy, and market conditions.
Combs Studios LLC makes no guarantee of earnings, audience growth, or specific outcomes, and all materials are provided for entertainment and educational purposes only.
Indemnification
You agree to indemnify and hold harmless Combs Studios LLC, its officers, employees, contractors, affiliates, and partners from any claims, losses, or damages arising from:
Your misuse of the Licensed Materials;
Your violation of these Terms; or
Any content or representations you create or distribute using the Licensed Materials.
By continuing to use the H2Viral system, you affirm that you understand and accept these responsibilities in full.
Section 7 — Intellectual Property & Ownership
All content, frameworks, and materials offered through H2Viral — including the H2Viral Machine, H2Viral Pro Expansion Pack, H2Viral Platinum Upgrade, and any future updates, bonuses, or affiliated releases (collectively, the “Licensed Materials”) — remain the exclusive intellectual property of Combs Studios LLC.
These assets are protected by U.S. and international copyright, trademark, and intellectual-property laws.
Ownership & Rights
You receive a limited-use license, not ownership.
All rights, title, and interest in and to the Licensed Materials — including scripts, hook formulas, creative frameworks, designs, brand marks, and supporting files — remain solely with Combs Studios LLC.
Unauthorized copying, redistribution, or derivative resale is strictly prohibited.
Limited License Scope
You may:
Use the Licensed Materials to create your own original content, ads, or campaigns.
Adapt and personalize scripts for your own marketing or educational purposes.
Display your finished work publicly, provided it does not imply partnership, endorsement, or co-branding with Combs Studios LLC.
You may not:
Sell, gift, or distribute the Licensed Materials in raw or source form.
Upload or contribute them to AI training models, data repositories, or shared drives.
Claim authorship of any original H2Viral frameworks, scripts, or trademarks.
Reverse-engineer, decompile, or extract proprietary content for commercial duplication.
™ Trademarks & Brand Elements
The names H2Viral, H2Viral Machine, H2Viral Pro Expansion Pack, H2Viral Platinum Upgrade, and all associated logos, taglines, and trade dress are trademarks of Combs Studios LLC.
Use of these marks without written consent is prohibited.
No license or right to use any trademark or brand identifier is granted under this Agreement.
Third-Party Mentions
References to tools, brands, or services (e.g., Canva, CapCut, ElevenLabs, TikTok, YouTube) are provided for illustration only.
All such names and marks remain the property of their respective owners, and no endorsement or affiliation is implied.
Reservation of Rights
All rights not expressly granted remain reserved by Combs Studios LLC.
Any unauthorized use, reproduction, or distribution of the Licensed Materials may result in termination of your license and potential legal action for damages or injunctive relief.
Section 8 — Limitation of Liability & Disclaimers
The H2Viral Machine, H2Viral Pro Expansion Pack, H2Viral Platinum Upgrade, and all related materials (collectively, the “Licensed Materials”) are provided by Combs Studios LLC strictly for educational, informational, and entertainment purposes.
Your success depends on many factors outside our control — including your skills, effort, timing, resources, and marketplace conditions — and therefore individual results will vary.
No Guarantees or Earnings Claims
The Licensed Materials are intended to inspire and educate; they are not promises of financial, marketing, or performance outcomes.
Any examples, testimonials, or success stories are illustrative only and should not be interpreted as average, typical, or guaranteed results.
Combs Studios LLC makes no warranty, express or implied, that use of the Licensed Materials will generate specific revenue, engagement, or growth.
Affiliate Relationships & Compensation Disclosure
Some links, recommendations, or offers shared within H2Viral content may be affiliate partnerships, meaning we may earn a small commission if you purchase through those links — at no additional cost to you.
We only promote tools or programs we genuinely believe add value to creators, but you are encouraged to perform your own due diligence before purchasing any third-party products.

In no event shall our total aggregate liability exceed the amount you paid for the specific product giving rise to the claim.
You assume full responsibility for your own implementation and for any outcomes resulting from your decisions or actions.
Cookies & Data Tracking

Section 9 — Indemnification & Remedies
By purchasing, accessing, or using any H2Viral product or service (“Licensed Materials”) provided by Combs Studios LLC, you agree to assume full responsibility for how you use the materials and to protect the Company from any harm resulting from misuse or violation of these Terms.
Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless Combs Studios LLC, its owners, officers, employees, contractors, licensors, affiliates, and partners (“Released Parties”) from and against any and all claims, damages, liabilities, losses, costs, or expenses —including reasonable attorney’s fees—arising from:
Your breach of these Terms or any applicable law;
Your violation of third-party rights (including copyrights, trademarks, privacy, or publicity);
Content you create, publish, or distribute using the Licensed Materials;
Misrepresentation of results, income, or outcomes;
Any disputes or enforcement actions by social-media or advertising platforms;
Technical failures, unauthorized access, or other issues resulting from your own actions or negligence.
You remain responsible for your own conduct and compliance across all platforms and jurisdictions.
Exclusive Remedy & Waiver of Claims
Your sole and exclusive remedy for dissatisfaction with any Licensed Material is the applicable refund policy stated at purchase (if offered).
Beyond that refund period, you waive the right to pursue further monetary damages, class-action participation, or collective relief.
You acknowledge that your license may be suspended or revoked—without refund—if you misuse the Licensed Materials, violate intellectual-property rights, or engage in misleading or unlawful activity.
Dispute Cooperation
Before initiating any formal claim, you agree to contact Combs Studios LLC in writing and allow at least 30 days for good-faith resolution.
Only if such resolution fails may either party pursue legal or arbitration procedures described under Section 10 (Governing Law & Dispute Resolution).
Continuing Obligation
Your duty to indemnify and hold harmless Combs Studios LLC survives:
the expiration or termination of your license, and
any refund, upgrade, or product replacement.
We occasionally recommend third-party products or services that we believe add genuine value. However, we are not responsible for the content, claims, or policies of any third-party websites or vendors linked from our materials or emails
Section 10 — Governing Law & Dispute Resolution
This Agreement and any dispute, claim, or controversy arising out of or relating to the H2Viral Machine, H2Viral Pro Expansion Pack, H2Viral Platinum Upgrade, or any related materials or services (“Licensed Materials”) shall be governed by and construed in accordance with the laws of the State of Tennessee, U.S.A., without regard to conflict-of-law principles.
Jurisdiction & Venue
You expressly agree that the exclusive venue for any legal action shall be the state or federal courts located in Davidson County, Tennessee.
By purchasing or using the Licensed Materials, you consent to the personal jurisdiction of those courts and waive any objection based on inconvenience, lack of jurisdiction, or improper venue.
Good-Faith Resolution
Before filing any claim or initiating arbitration, both parties agree to attempt in good faith to resolve the matter informally.
You must first send written notice describing your concern to Combs Studios LLC, allowing 30 days for review and response.
If no resolution is reached within that period, either party may proceed with the arbitration process below.
Binding Arbitration (U.S. Customers)
Except for intellectual-property disputes or claims of unauthorized use of the Licensed Materials, all other controversies shall be resolved exclusively through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Rules.
Arbitration shall take place in Nashville, Tennessee, and the proceedings shall be conducted in English.
The arbitrator’s award shall be final and binding, and may be entered in any court of competent jurisdiction.
Each party shall bear its own legal fees and costs unless otherwise determined by the arbitrator.
International Customers
If you reside outside the United States, you agree that disputes shall first attempt informal resolution under this section.
If unresolved, the matter may proceed to non-exclusive arbitration in Nashville, Tennessee, or another mutually agreed venue.
You agree that the governing law remains the laws of the State of Tennessee, U.S.A.
Class-Action Waiver
To the fullest extent permitted by law, you waive any right to participate in class, collective, or representative actions against Combs Studios LLC or its affiliates.
All claims must be brought in an individual capacity, and consolidation of multiple users’ claims is prohibited.
Limitation Period
Any claim or cause of action arising under this Agreement must be filed within one (1) year after the event giving rise to the claim, or it shall be permanently barred.
Section 11 — Entire Agreement & Severability
This Agreement, including these Terms of Service, the accompanying Privacy Policy, and any supplemental disclosures presented at the point of purchase or sign-up, collectively represent the entire understanding between you (“User,” “Customer,” or “Purchaser”) and Combs Studios LLC (“Company,” “we,” “us,” “our”) concerning the purchase, access, and use of the H2Viral Machine, H2Viral Pro Expansion Pack, H2Viral Platinum Upgrade, and all related digital materials (“Licensed Materials”).
This Agreement supersedes all prior or contemporaneous communications, negotiations, or understandings—whether oral, written, or implied—relating to the Licensed Materials.
Modifications & Updates
Combs Studios LLC reserves the right to modify, update, or amend these Terms at any time, with or without notice.
Continued access to or use of the Licensed Materials following any such updates constitutes your acceptance of the revised Terms.
If any material changes occur, we may notify users via email or an on-site notice.
Severability
If any provision of this Agreement is found to be invalid, unlawful, or unenforceable, such provision shall be modified or limited to the minimum extent necessary to make it enforceable while preserving the parties’ intent.
The remaining provisions shall continue in full force and effect.
Headings and section titles are included for convenience only and shall not affect the meaning or interpretation of any provision herein.
Assignment
